1. SCOPE OF APPLICATION
1. The general terms and conditions set out here (hereinafter: "T&C") apply to all orders and purchases of products on the website http://sito.quadrisrl.com (hereinafter: "Website") managed by QUADRI s.r.l., with registered office at via Gozzano snc, 04012 Cisterna di Latina (LT) - Tax Code and VAT No. 025133205945 - REG. IMPRESE 177126 Latina.
2. WARNINGS
1. The Customer is required to carefully read the T&C before placing any purchase order. By accepting the T&C and submitting an order, the Customer declares:
a) to have read, understood, and fully and unreservedly accepted the T&C;
b) to be a consumer and to wish to purchase the Products exclusively for personal use and not to resell them as part of a commercial or business activity of any kind;
c) to authorize QUADRI s.r.l. to store, process, use, and transfer to third parties and/or abroad the (personal) data contained in the order for the purpose of executing the same.
2. QUADRI s.r.l. will do its best to ensure that the information contained on the Website is accurate and up to date. However, it is not possible to offer guarantees in this regard. The Customer acknowledges and accepts that the Products may not fully comply with the indications, specifications and/or photographs shown on the Website.
3. ORDERS
1. The sales contract between QUADRI s.r.l. and the Customer is considered finalized with the sending to the Customer, at the e-mail address provided by the latter with the purchase order, of the written confirmation of shipment.
2. QUADRI s.r.l. will consider any requests for order cancellation received before the Products are shipped to the customer.
3. In the event that a specific Product included in the Customer's order is no longer available, QUADRI s.r.l. will have no obligation to supply the Product in question, but will only be required to promptly inform the Customer of this circumstance. If only some of the Products listed in the order are available, QUADRI s.r.l. will contact the Customer to ask whether they wish to cancel the order or are willing to receive only the available Products; in this case, the Customer will only be charged for the Products they receive.
4. QUADRI s.r.l. reserves the right to reduce, at its sole discretion, the quantity of Products that can be purchased on the Website.
5. Measurements, features, and illustrations of the products are indicative and subject to change without notice should technical or production requirements demand it. Considering that production is artisanal, slight differences may be found between different batches of the same product.
4. PRICES
1. The prices of the Products, expressed in the currency shown in the cart, will in any case be those indicated on the invoice. QUADRI s.r.l. will nevertheless do its best to ensure that the prices indicated on the website are correct and up to date.
2. Shipping and delivery costs may vary depending on the country and will be charged to the Customer at the time of shipment of the ordered Products, according to the current shipping rates listed in the relevant section of the Website.
3. Payment will be made by the Customer at the time of shipping confirmation by credit card or by other methods indicated in the relevant section of the Website.
5. DELIVERY
1. The delivery of the Products will be made to the delivery address indicated by the Customer in the order.
2. In principle, the Products will be delivered within 30 (thirty) days from the order confirmation by QUADRI s.r.l., it being understood that delivery times may vary depending on the country of destination. In the event that delivery is delayed for reasons not attributable to QUADRI s.r.l., the Customer will be informed, as far as possible, of the new delivery date.
3. QUADRI s.r.l. reserves the right, at its sole discretion, to refuse, suspend or cancel the delivery or fulfillment of any of its obligations arising from the sales contract, in the event of suspected fraud, non-fulfillment or violation by the Customer of obligations undertaken towards QUADRI s.r.l. with previous orders and/or sales contracts. If the ordered Products require customs clearance (depending on the destination country) and the Customer decides not to receive the order once it has arrived at customs, QUADRI s.r.l. will not grant a refund for the goods, which will be abandoned on site.
6. COUPONS AND ONLINE DISCOUNT VOUCHERS
1. The validity of the promotions available online applies exclusively and solely to the Website and, unless otherwise expressly indicated, ends on the last day of the indicated month, unless stocks run out. QUADRI s.r.l. reserves the right to make changes or exclude certain products from promotions. For further information, please contact customer service.
2. Cart discounts – resulting from the use of promotional coupons or special conditions applied to the customer – cannot be combined with other promotions.
3. Users in possession of a coupon including a promotional code that guarantees a discount or a free gift can use it to make purchases exclusively online, on the websites www.quadriarl.com and www.sito.quadrisrl.com . The coupon highlights the promotional code, the amount of the discount or the free gift, and the end date of the promotion.
4. The promotional code must be entered during the checkout process, before payment, and guarantees the discount/gift immediately; it is the customer's responsibility, before confirming the purchase and proceeding with payment, to verify that the promotional code has been successfully processed and that the purchase includes the discount/gift. No claims will be accepted after the purchase has been confirmed.
5. The promotional code cannot be combined with other promotional codes and can be used only once, unless otherwise indicated on the coupon. The purchase using this code must be made by the date specified on the coupon.
7. RIGHT OF WITHDRAWAL
The online customer acting as a consumer is granted the right of withdrawal from the contract, as provided for by Articles 64 – 67 of Legislative Decree no. 206/2005, known as the Consumer Code.
It should be noted that this right is reserved only for natural persons, that is, private consumers acting for purposes unrelated to their profession. There is no right of withdrawal for legal entities and natural persons who act, with reference to the purchase contract, in a professional context.
Pursuant to and within the limits of Article 64 of the Consumer Code, the consumer has the right, within 14 calendar days from receipt of the purchased products, to exercise the right of withdrawal, consisting of the possibility to return the received products and obtain a refund of the price paid, without penalty and without the need to specify the reason.
This right applies to all products purchased online on this site, with the exception of audiovisual or computer software products delivered sealed and subsequently opened by the customer.
The costs of returning the product are borne by the consumer.
The right of withdrawal is completely forfeited if the returned product is used, or is not intact, due, for example, to the absence of integral elements of the product (accessories, cables, instruction manuals, etc.) or because the product has been damaged for reasons other than transport from the Seller to the consumer, not previously reported.
Without limiting the right of withdrawal, upon delivery of the product the consumer, who has reason to believe that the product has been damaged during transport, must refuse delivery or accept it with express reservation.
Each collection of intact packages must be carried out by the customer by writing the statement "INTEGRAL PACKAGE, COLLECTION WITH RESERVATION OF CONTENT CHECK" on the appropriate accompanying document (art. 1698 Civil Code). Any anomaly must then be communicated within eight days by registered letter with return receipt addressed to QUADRI s.r.l.
Procedure for exercising the right of withdrawal
To exercise the right of withdrawal, it is necessary to send, within 14 calendar days from receipt of the purchased product, a communication clearly stating the intention to withdraw from the purchase contract.
This communication must be sent by registered letter with return receipt addressed to QUADRI s.r.l.
The consumer must then arrange, using a courier of their choice, to ship the product in its original packaging and complete with all accessories, instruction manuals, and everything originally included.
The consumer must make this shipment within ten working days from the date on which the communication of exercise of the right of withdrawal was sent.
Important notes
Transport costs and responsibility for the goods during shipment, as provided by law, are borne by the consumer.
It is therefore recommended to insure the product with the chosen courier, taking care to pack the goods carefully, where possible placing the original packaging in an external box and, in any case, avoiding damaging the product with adhesive tapes, labels, etc. The product must be returned intact and complete with all its parts and accessories, including any warranties, instructions, licenses, cables, etc. In the event of transport damage occurring during the return, the Seller will notify the consumer of the damage within five working days of receiving the product, allowing the consumer to file a claim with the courier used for transport. The damaged goods will be made available for return and the withdrawal request will be simultaneously cancelled.
As soon as it is able to confirm that the required conditions have been met, QUADRI s.r.l. will send the Customer an email confirming acceptance of the return and will initiate the refund procedure so that the Customer receives a refund for the returned Products within thirty (30) days, regardless of the payment method previously used by the Customer. The refund of the amounts paid by the Customer will always be made exclusively in favor of the Customer who made the payment.
In the event that the above conditions have not been met, the Customer will not be entitled to a refund of the amount paid to QUADRI s.r.l.. However, the Customer will only have the right to have the returned Products sent back to them, at their own risk and expense. If the Customer does not request to have the returned Products back within thirty (30) days from the relevant communication by QUADRI s.r.l., QUADRI s.r.l. will have the right to retain them along with the amount received in relation to the transaction.
8. WARRANTY AND LIMITATION OF LIABILITY
1. The legal warranty of QUADRI s.r.l. is limited to any apparent defects of the Products - expressly excluding, without limitation, any implied warranty regarding quality and fitness for purpose for the Customer - for a period of 2 (two) years from the delivery of the Products.
2. The legal warranty cannot be invoked by those who purchased the products as part of their business or professional activity, indicating their VAT number.
3. The warranty only entitles you to obtain a refund of the amount paid for defective Products, provided that the defect is reported to QUADRI s.r.l. within 2 (two) months from when it was discovered.
4. In addition to what is indicated above (arts. 20-21), the right to reimbursement is subject to the following conditions, under penalty of forfeiture of the warranty:
a) before sending back the defective Products to QUADRI s.r.l., the Customer must contact the QUADRI s.r.l. customer service according to the procedures indicated in the relevant Returns section on the Website - to obtain authorization to proceed with the return;
b) the defective Products will be collected by QUADRI s.r.l., at its own expense.
5. Once the Product has been received and its defectiveness ascertained, QUADRI s.r.l. will send the Customer an email confirming acceptance of the return and will initiate the refund procedure in favor of the Customer for the price paid for the defective Product, which must be completed within thirty (30) days, regardless of the payment method previously used by the Customer. The refund of the amounts paid by the Customer will always be made exclusively in favor of the Customer who made the payment.
6. Without prejudice to the above warranty, QUADRI s.r.l. excludes any and all liability (contractual or non-contractual) towards the Customer, within the limits of the applicable mandatory provisions.
7. The maximum overall liability of QUADRI s.r.l. shall in no case exceed the amount paid by the Customer for the purchase of the Product.
9. GENERAL PROVISIONS
1. In the event that one or more provisions of these T&C should be null, voidable, illegal or ineffective, this will not result in the total ineffectiveness of the T&C. The provision in question will be replaced by a similar valid provision that duly takes into account the intention and content of the same, in compliance with and pursuant to the applicable regulations.
2. These T&C are subject to substantive Swiss law (excluding the Swiss law on private international law and international treaties, in particular the United Nations Convention on Contracts for the International Sale of Goods). Any disputes that may arise shall be submitted to the exclusive jurisdiction of the competent court of LATINA (Italy).
10. BREXIT UPDATE
1. Due to the political situation related to the United Kingdom's exit from the European Union ("Brexit"), it will be possible to make purchases with UK destination up to and including Thursday, October 31, 2019. Should any issues or delays arise, the company reserves the right to cancel such orders and refund the amounts.
